Welcome to Empire Rank ("Empire Rank", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of the Empire Rank website, mobile applications, APIs, and related services (collectively, the "Platform"). By creating an account, accessing, or using the Platform, you agree to these Terms.
You are responsible for all activities under your account.
Empire Rank provides a platform for: business discovery, business listings, rankings, reviews and ratings, business verification, badges and awards, premium subscriptions, analytics, APIs, and advertising and promotional services. We may add, modify, or remove features at any time.
Users may register an account, create a profile, submit reviews, react to reviews, save favorites, and report abuse. You agree not to create fake accounts, impersonate another person, use bots or automation, share account credentials, or circumvent security measures. Accounts violating these Terms may be suspended or permanently removed.
Businesses may create listings, claim existing listings, edit information, purchase subscriptions, upload media, and respond to reviews. Business owners are responsible for ensuring that all information is accurate, current, lawful, and non-misleading. Empire Rank may edit, reject, or remove listings that violate these Terms.
Verification is intended to improve trust. Verification does not guarantee service quality, endorse a business, or guarantee authenticity forever. We reserve the right to revoke verification at any time.
Users may submit reviews based only on genuine experiences. Reviews must be honest, relevant, respectful, and based on real interactions. Reviews may not include fake experiences, spam, hate speech, personal attacks, illegal content, confidential information, threats, extortion, or advertising. Empire Rank may remove reviews at its sole discretion.
Empire Rank employs automated fraud detection systems to protect platform integrity. Reviews may be flagged or rejected based on signals such as repeated submissions from the same IP address, newly created accounts exhibiting suspicious behavior, device fingerprint matches, or highly similar review content. Reviews may be marked as pending, suspicious, or rejected according to internal fraud detection criteria. Users attempting to manipulate rankings may have reviews removed, accounts suspended, businesses penalized, rankings adjusted, or badges revoked.
Empire Rank rankings are generated using proprietary algorithms that consider multiple factors including ratings, review volume, engagement, and verification status. Rankings are recalculated periodically and may change without notice. Rankinations are informational only, are not endorsements, may change daily, and cannot be purchased. Attempting to manipulate rankings is prohibited.
Badges are awarded automatically based on platform criteria. Badges may expire, may be revoked, do not guarantee quality, and cannot be transferred. Permanent badges remain subject to fraud investigations.
Premium subscriptions may include higher visibility, verification benefits, enhanced analytics, and additional business tools. Subscriptions renew automatically unless canceled. Prices are subject to change with prior notice.
Payments are processed through third-party payment providers. Empire Rank does not store complete payment card information. Refunds are governed by our Refund Policy.
You retain ownership of content you submit. By uploading content, you grant Empire Rank a worldwide, non-exclusive, royalty-free license to display, host, store, reproduce, modify for formatting, and promote Platform content. You warrant that you own or have the rights to the content you submit.
You may not submit false reviews, purchase fake reviews, sell reviews, scrape the Platform, reverse engineer the Platform, distribute malware, upload illegal content, harass other users, interfere with Platform operation, abuse APIs, or attempt unauthorized access.
All Platform content including software, design, logos, rankings, databases, algorithms, and graphics are owned by Empire Rank or its licensors. You may not copy or redistribute Platform content without permission.
Developers using our APIs must authenticate properly, respect rate limits, protect API credentials, avoid abusive requests, and comply with API documentation. API access may be revoked for misuse.
Your use of the Platform is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect personal information.
Empire Rank may integrate with third-party providers including payment gateways, maps, authentication providers, analytics services, and email services. We are not responsible for third-party services.
We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, upgrade systems, suspend services, or modify features without prior notice.
The Platform is provided "AS IS" and "AS AVAILABLE." We make no warranties regarding accuracy, reliability, availability, fitness for a particular purpose, or non-infringement. Business listings, reviews, and rankings represent user-generated content or algorithmic calculations and should not be considered professional advice or endorsements.
To the maximum extent permitted by law, Empire Rank shall not be liable for lost profits, lost revenue, data loss, business interruption, indirect damages, consequential damages, or punitive damages. Our total liability shall not exceed the amount paid by you to Empire Rank during the preceding twelve (12) months.
You agree to indemnify and hold harmless Empire Rank and its affiliates from claims, damages, liabilities, losses, costs, and expenses arising from your use of the Platform, your submitted content, your violation of these Terms, or your violation of applicable law.
We may suspend or terminate accounts for fraud, spam, fake reviews, abuse, illegal activity, or Terms violations. Termination may occur without prior notice where necessary to protect the Platform or other users.
We may update these Terms from time to time. Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
These Terms shall be governed by the laws of the jurisdiction in which Empire Rank operates, without regard to conflict of law principles.
